Subject: Filing of a cassation appeal against the judgment of the Appellate Court in Kraków in the case against the State Treasury

In relation to Current Report no. 22/2018 of 21 December 2018 concerning the judgment of the Appellate Court in Kraków in the case of Optimus S.A. (currently operating under the name CD PROJEKT S.A., hereinafter referred to as “the Company”) vs. the State Treasury concerning damages sustained by the Company as a result of erroneous decisions of tax authorities, the Management Board hereby announces that its plenipotentiary has confirmed the filing of a cassation appeal against the judgment of the Appellate Court in Kraków delivered on 21 December 2018. The appeal was filed with the Appellate Court in Kraków and is addressed to the Supreme Court.
The cassation appeal concerns the aforementioned judgment insofar as it reverses the judgment of the District Court in Kraków (previously disclosed in Current Report no. 13/2014 of 1 August 2014) by dismissing the lawsuit and dismissing the Company appeal related thereto, as well as parts of the judgment related to the costs of litigation.
