On 7 December 2015 the Appellate Court in Kraków, which is currently considering the case of CD PROJEKT vs. State Treasure for monetary redress associated with unlawful tax decisions in the so-called “Optimus Case”, decided to petition the Supreme Court to resolve a legal issue related to allegations expressed in the State Treasury’s appeal, and to adjourn the case until such time as a decision can be reached by the Supreme Court.
Today, the Supreme Court concurred with CD PROJEKT’s request to decline judicial review of the case. As a result of this decision, the case is remanded to the Appellate Court for further proceedings.
